OCBC PLATINUM CREDIT CARD 1% REBATE ON HOSPITALS, MEDICAL CLINICS, DENTAL CLINICS & GREAT EASTERN AND OVERSEAS ASSURANCE CORPORATION INSURANCE PROGRAM INFORMATION

1. DEFINITIONS

OCBC
means OCBC Bank;

card
means OCBC Platinum Credit Card issued by OCBC Bank;

card account
means the account maintained with OCBC Bank in respect of the card;

cardmember
means a person to whom a card is issued and includes the supplementary
cardmember where the context requires;

program
means the OCBC Platinum Credit Card 1% Rebate on Hospitals, Medical Clinics & Great Eastern and Overseas Assurance Corporation Insurance Program; and

retail purchase
means any purchase of goods and/or services for personal use effected by using the card (exclude cash advance transactions, balance transfer transactions, CashWise, Paylite, IPP transactions, bank charges, finance, late charges and any other form of service/miscellaneous fees) and OCBC Bank may at its absolute discretion and without notice, determine and/or include any card transaction as retail purchase under the Program.

2. PARTICIPATION

a. A cardmember whose card account is in good standing, as determined by OCBC in its sole discretion, is entitled to participate in the Program.
b. If a cardmember terminates his/her card account, any accumulated rebate shall be automatically forfeited; such rebate shall not be transferable to any other card account.
c. If the principal cardmember’s card account is terminated at any time for any reason, whether by the principal cardmember or OCBC, the principal cardmember and the supplementary cardmember will forthwith be disqualified from participating in the Program and all rebate then accumulated shall automatically be forfeited.
d. If a supplementary card is terminated at any time for any reason, the principal cardmember will not be disqualified from participating in the Program.

3. ISSUANCE OF REBATE

a. Under the Program, cardmembers will receive cash back equivalent to 1% of the amount spent on hospitals, medical clinics, Great Eastern and Overseas Assurance Corporation Insurance in Singapore. The rebate rate may be varied by OCBC from time to time without notice.
b. A cardmember may accumulate a maximum of S$88 cash rebate per calendar month. Rebates will be credited into the cardmember’s account in the following month’s statement.
c. In determining the total amount of spending on hospitals, medical clinics, Great Eastern and Overseas Assurance Corporation Insurance in Singapore for purposes of calculation of rebate, refunded, disputed, unauthorized or fraudulent spending and goods and services taxes will not be taken into account. For the avoidance of doubt, cash advance transactions, balance transfer transactions, CashWise, Paylite, IPP transactions, bank charges, finance, late charges and any other form of service/miscellaneous fees shall not be taken into account.
d. OCBC reserves the right in its sole and absolute discretion to determine the type of eligible transactions which qualify under the Program. This includes without limitation, whether a transaction is to be considered a hospital, medical clinics, Great Eastern and Overseas Assurance Corporation Insurance transaction. If OCBC in its sole and absolute discretion decides that any transaction is not to be considered a hospital, medical clinics, Great Eastern and Overseas Assurance Corporation Insurance transaction, or that any transaction does not otherwise qualify under the Program, the rebate may not be awarded.
e. OCBC is entitled, in its absolute discretion, at any time and from time to time and without notice and without giving any reason, to include or exclude any card transaction or charges or retail purchase in the calculation of rebate or to otherwise vary the basis of calculation of rebate.
f. Any refunded amount spent on hospitals, medical clinics, Great Eastern and Overseas Assurance Corporation Insurance in Singapore will not be taken into account in the calculation of the rebate.
g. Rebate earned by a supplementary cardmember will be credited to the card account of the principal cardmember.
h. Rebate earned on the card cannot be transferred or combined with any other OCBC Credit Card(s).

4. OTHER CONDITIONS

a. OCBC may at anytime vary, modify or amend these terms and conditions as it may, in its absolute discretion, think fit, and the cardmember shall be bound by such variation, modifications and amendments.
b. OCBC may cancel the accumulated rebate credited to the card account in the event of any abuse or fraud in respect of the card or the rebate.
c. OCBC’s decision on all matters relating to this Program will be final and binding on all participants. Without prejudice to the generality of the foregoing, OCBC’s record shall be conclusive for all purposes and be binding on all participants.
d. OCBC reserves the right at its absolute discretion to suspend or terminate the Program or vary, delete or add to any of these terms and conditions at any time or from time to time without notice.
e. OCBC shall not be responsible for any loss or damage to any person in connection with the Program howsoever arising, including any error in computing chances, any breakdown or malfunction in any computer system or equipment, any notice which is misdirected or lost in the post.
f. These terms and conditions shall be governed by the laws of Singapore and the participants in the Program irrevocably submit to the non-exclusive jurisdiction of the courts of Singapore.
g. A person who is not a party to any agreement governed by these terms and conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any of these terms and conditions. Without prejudice to the generality of the above, the consent of any third party is not required for any variation (including any release or compromise of any liability) or termination of these terms and conditions, notwithstanding any term herein to the contrary.
h. In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the promotion, these terms and conditions will prevail.
